By accessing and using the services provided by contrafpha B.V. ("we", "our", or "us"), including our website at contrafpha.life and our property management services, you ("you" or "client") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you and contrafpha.
contrafpha B.V. is a private limited company registered in the Netherlands with registration number 77420695 and VAT number NL835071946B01. Our registered office is located at Vijverweg 246, 4854 MC Breda, North Brabant, Netherlands. We provide professional property management services in Breda and throughout North Brabant.
contrafpha provides comprehensive property management services including but not limited to tenant screening and management, property maintenance coordination, rent collection and financial management, legal compliance assistance, property marketing and leasing, and regular property inspections. Specific services will be detailed in individual service agreements with clients.
As a client of contrafpha, you agree to provide accurate and complete information about your properties, maintain appropriate insurance coverage for your properties, comply with all applicable Dutch housing laws and regulations, pay all fees and charges as agreed in your service agreement, provide timely access to properties for inspections and maintenance, and inform contrafpha of any material changes affecting your properties or circumstances.
Fees for our services will be specified in individual service agreements. Payment terms are typically monthly in arrears unless otherwise agreed. Late payment may result in interest charges and suspension of services. All fees are quoted exclusive of VAT where applicable. We reserve the right to adjust fees with reasonable notice in accordance with your service agreement.
All content on our website and in our materials, including text, graphics, logos, images, and software, is the property of contrafpha or our licensors and is protected by Dutch and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission. The contrafpha name and logo are trademarks of contrafpha B.V. and may not be used without permission.
We are committed to protecting your privacy and personal data in accordance with the General Data Protection Regulation (GDPR) and Dutch data protection laws. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which forms part of these terms. By using our services, you consent to our data practices as described in our Privacy Policy.
To the maximum extent permitted by Dutch law, contrafpha's liability for any claims arising from our services is limited to the fees paid by you in the 12 months preceding the claim. We exclude liability for indirect, consequential, or punitive damages. Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Dutch law. We maintain professional indemnity insurance to cover our services.
contrafpha shall not be liable for any failure or delay in performance under these terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, government actions, or technical failures. In such circumstances, we will use reasonable efforts to resume normal service as soon as possible.
Either party may terminate the service agreement with appropriate notice as specified in the individual service agreement, typically 30 days written notice. contrafpha may terminate services immediately for non-payment of fees, breach of these terms, or illegal activities. Upon termination, you remain liable for all fees accrued up to the termination date, and we will transfer relevant property management documents and tenant deposits as required by law.
If you have a complaint about our services, please contact us first at support@contrafpha.life or +31 102643222. We will investigate and respond to complaints promptly. If we cannot resolve the matter directly, disputes may be referred to mediation or arbitration in accordance with Dutch law.
These Terms of Service are governed by and construed in accordance with Dutch law. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the Dutch courts. If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Our website is provided for informational purposes about our property management services. You may use the website for lawful purposes only and must not use it in any way that violates applicable laws or regulations. We reserve the right to modify or discontinue the website at any time without notice. While we strive to keep information accurate and up-to-date, we make no warranties about the completeness or accuracy of website content.
contrafpha reserves the right to modify these Terms of Service at any time. Changes will be posted on our website with an updated "Last updated" date. Continued use of our services after changes are posted constitutes acceptance of the modified terms. For material changes affecting existing service agreements, we will provide reasonable notice to clients.
